Council must now decide at its Oct 1st council meeting if will go ahead with a referendum (as requested by the register) or if it will abandon the project which appears to be the case in most similar situations

Letter from a concerned resident

Without prejudice

I find the timing of the article, “Maison Joseph Théorêt owner joins condo debate”, and the 4 open houses very interesting given the September 11 register for residents to vote against the construction project and the efforts of the developer “with deep pockets” to sway public opinion.

Where was Ms. Gorchinsky over the last 18 months when many people devoted much time and effort and attended many Borough council meetings to ensure that not only the Théorêt House itself but the general site of this historic house was preserved? The original project design called for it to be moved between two 8 storey towers, thereby taking it out of its natural setting and probably damaging its structure.

At an Urban Planning Committee meeting at City Hall, November 12, 2012, Mr.Vered was asked if he was aware of the International Charter on the Protection of Heritage Sites and that the house should not be moved. Mr. Libman, who is working as a consultant with the Vered Group to expedite the re-zoning process, downplayed this by asserting that the house was not on the list of Heritage Properties recognized by the Conseil de patrimoine, until he was shown the list. Mr.Libman had also declared that the house was not in good shape which was repeated by the real-estate agent, Mr. Boyer. The photos in the article do not seem to support this claim. So the tactics seem to have changed from the Maison Théorêt is not worth salvaging to give us the project and we’ll leave it in place surrounded by 115 condos whose owners are the only ones who will have access to it.

It is of concern that a consultant with the experience of Mr. Libman appeared to not be aware of important local and international guidelines regarding modern and progressive methods to preserve heritage properties and associated heritage sites (See some documents at: http://aprpr.org/?page_id=5673#refdocuments ). Preserving the site of the heritage property is a key component of preserving the heritage property itself. Residents should recall what the Borough allowed to be constructed around the historic Meighen house ( http://aprpr.org/?p=6907 ).

Another question that arises is should private owners of heritage properties be allowed to potentially make arrangements to sell such properties to developers in advance of a project that does not meet local zoning conditions? Will Ms. Gorchinsky stand to make a handsome profit but not have to endure the years of construction noise and dirt and the increased traffic from 115 condo owners onto streets already too small? Also of concern to residents is the difficulty of selling their property during the construction project and a decrease in property values.

Eligible voters in the affected zones which will be specified in a public notice in the Cités Nouvelles newspaper of August 28 (roughly a rectangle bordered on the North by Gouin Blvd from École St-Gerard to Jacques-Bizard Blvd and on the South on Pierrefonds Blvd from Jacques-Bizard Blvd to the southernmost intersection of Harry Worth and Jolicoeur) need to show their desire to protect the Théorêt House and its full site location and preserve their own quality of life without a giant construction project in an area not appropriate for it. The ONLY WAY to do this is by signing the register in the Council Room at Pierrefonds-Roxboro Borough Hall (next to the Pierrefonds Library), on Wednesday, September 11, 2013, between 9am and 7pm.

Il pourrait être présenté que le commentaire de la mairesse ne serait pas complet. On pourrait dire plutot dans ce cas-ci, que l’arrondissement a introduit un nouveau règlement soit le CA29 0045 et ce, avant que le projet de développement soit présenté au conseil. De cette manière, dans ce cas-ci, le projet a pu pourra être traité et approuvé par le conseil comme une résolution du conseil plutôt que d’avoir à être traiter comme un plein changement de zonage qui implique un règlement d’arrondissement. Il semble donc, dans ce cas, que le projet présenté comme une résolution du conseil sous CA29 0045 permet à l’arrondissement de faire une pierre deux coups, i.e. éventuellement autoriser le projet, malgré le fait que le projet ne respecte pas le nombre d’étages dans le règlement de zonage actuel CA29 0040. Dans ce cas-ci il n’y aura pas de reglement pour changer le règlement de zonage.

Do they really treat all developpers equally? Is the mayor’s statement complete? It could be presented that in this case, the borough first introduced a new borough bylaw CA29 0045 so that in this case, the project could be treated and approved as a council resolution rather than having to change the zoning bylaw first and then having to approve the project. So in this case, the project presented as a council resolution under CA29 0045 appears to allow the borough in one swoop, to potentially approve the project and permit the project despite the fact that it does not respect the number of storeys in the actual zoning bylaw CA29 0040.

Comments concerning the above article

– The urban plan referred to by the developper is more of an administrative document compared to the zoning bylaw which is an actual bylaw. Some consider the urban plan as mainly a conceptual and guiding document
– Residents opposed the urban plan densities approved by the P-R borough back in 2004.
– The area designated 18-06 in the urban plan information is in fact proposed for 1-8 storeys not 1-10 storeys.

– The article does not contain comments from residents who proposed instead townhouse or condos from 2-4 storeys. The small size of the lot even combined with the corner triplex lot and Joseph Theoret heritage house lot makes the architectural sketch unrealistically or in fact misleadingly large.

– There was one other information omitted or misleading also in this sentence appearing in the article: « In addition, the building plan now calls for one six-storey tower with 125 units, not two eight-storey towers containing 146 units. »
The actual zoning and plan permits an additional 7th floor up to 40% of the floor space, called a mezzanine and planned as an exercise room according to the developper Mr. Vered.

– The project will be subject to a register or a direct vote by eligible voters – residents should remain vigilant for this information

– The gazette illustration showing the ‘’untouched’’ Heritage House surrounded by parking is misleading. The heritage building is not untouched. It is a disguised demolition by environmental inconsistency. It is difficult to comprehend why the borough is forcing the issue on the property of the Theoret house when surely the city has land where a high rise will not involve destroying the surroundings of a heritage building. Very rare old homes that still remain surely deserve better protection than to have them situated on high rise zoned land.

Construite vers 1780, elle fut agrandie dans les années suivantes et avant 1849, date à laquelle on mentionne  » une allonge en bois « . Elle fut recouverte de clins de bois vers 1920. Son état de conservation est remarquable. – It is one of the rare rural houses of the twinned style on the Pierrefonds terrritory. Built in 1780, it was enlarged in the following years and before 1849, the date that it is mentioned « a wooden enlargement » was made. It was again improved around 1920. It’s state of conservation is remarkable.
La maison Joseph-Théoret situé au 14784, boul. Gouin Ouest, et localisée dans l’arrondissement Pierrefonds-Roxboro, est bien citée par la Ville de Montréal.

La citation est une mesure de protection légale, applicable en vertu de la Loi sur les biens culturels (art. 70) (cherchez article 70), à laquelle une municipalité peut recourir pour protéger un monument dont la conservation présente un intérêt public. Cette mesure impose certaines obligations au propriétaire, dont celle de conserver en bon état son immeuble (art.79 (cherchez article 79)).
