== How does this relate to Pierrefonds-Roxboro? ==

2007-December – Pierrefonds-Roxboro modified its urban plan by adding Objective 22 – Ensure that the principles for sustainable development are integrated

In particular objective 22 contains the following action: Minimization of impacts associated with climate change.

It is interesting to ask why, since December 2007, has the borough chosen NOT to apply the actions of Objective 22 to a number of projects that have since been approved by the borough.

Un des impacts des changements climatiques sera des orages qui donneront des episodes de pluie plus intenses. Les episodes de pluie intenses peuvent causer des refoulements d’egouts par endroits.

Comment se proteger?

Les compagnies d’assurance commencent a charger plus pour les polices d’assurances a cause des couts croissant causes par les dommages d’eau tels que les refoulements d’egouts

Gestions de risques et impacts de la part de l’arrondissement

En mai 2007, lors de la consultation du plan d’urbanisme, l’arrondissement de Pierrefonds-Roxboro a ete informe des risques et impacts possibles causes par les episodes de pluie plus intenses resultant des changements climatiques. (Cliquez ici pour voir la presentation – consultez les pages 8 a 27)

Suite a la consultation l’arrondissement a adopte un plan d’urbanisme modifie dans lequel on a ajoute un objectif 22 portant sur le developpement durable (voir page 17 dans le plan)

L’objectif 22 du plan contient donc un nombre d’items qui contribueraient a proteger l’arrondissement et les residents des dommages causes par l’eau. On retrouve entre autre:

- la protection des milieux naturels d’intérêts, dont les milieux humides…
(les mileux humides contribuent a ralentir l’ecoulement d’eau de surface)

- la protection des peuplements d’arbres rares, matures, centenaires ou d’intérêt local …
(les arbres contribuent a relentir l’ecoulement d’eau de surface)

- la gestion des constructions et des ouvrages dans les plaines inondables et dans la bande riveraine;
(la protection des plaines inondables et riverraines contribuent a gestion securitaire de l’eau)

- le maintien du régime hydrique des cours d’eau intérieurs en encadrant la planification des projets de développement;
(Il est important de maintenir un regime hydrique approprie aux conditions climatiques)

- le détournement de l’enfouissement des matières résiduelles ….
(les eaux usees residentielles (et les eaux d’ecoulement), meritent d’etre mieux gerees)

- l’intégration des critères de développement durable dans les processus décisionnels afin d’ajouter à l’analyse économique une évaluation des impacts sociaux et environnementaux, notamment par l’évaluation environnementale stratégique;
(Faisons nous de telles analyses afin de mieux proteger nos infrastructures et residents?)

- la mesure, par des indicateurs, du progrès vers le développement durable;
(On pourrait beneficier d’objectifs qui serviraient a reduire le nombre de dommages causes par l’eau dans l’arrondissement)

- la minimisation des impacts liés aux changements climatiques

Est-ce que l’arrondissement gere bien les risques et impacts?

- En juin 2010, l’arrondissement a adopte des nouveaux reglements d’urbanisme et zonage.

- Lors de la consultation publique associee, l’arrondissement a confirme qu’ils n’avaient pas evalues comment les nouveaux reglements respectaient l’objectif 22 du plan d’urbanisme.

- Aussi, il semble que ces reglements, prepares par une firme privee, auraient ete adopte par le conseil sans que les membres du conseil les auraient lu avant de les adopter.

- Est-ce de bonnes pratiques de la part de l’arrondissement pour minimiser les impacts lies aux changements climatiques?

- Est-ce que la gestion des risques de la part de l’arrondissement contribue a croitre les risques aux infrastructures et aux residents?

This paper is the published summary of the Bioinitiative Report (www.bioinitiative.org) which recommends that all schools should stay away from WI-FI connections and stay with wired networks for their computers. this paper (from Europe) appears to document clear evidence for EMF exposure and stress, breast cancer, and for childhood leukaemia.

Chronology of events

Summary
This page presents a chronology of the borough of Pierrefonds-Roxboro’s work with Daniel Arbour & Associes, ongoing since at least June 2007, to convert 10 existing urban planning and zoning bylaws and harmonize and update them into 5 unified bylaws.
See table 2 in this document for a table presenting the new bylaws and the bylaws they will replace. Table 2 also provide links to draft versions of the new bylaws.

Of concern:
- procedures used by borough are risky for protecting the public interest
- almost $300,000 spent to consultants since June 2007
- more than 1000+ pages of bylaws to replace existing bylaws yet residents have extremely limited information as to how new bylaws differ from existing bylaws
- Council apparently approved the bylaws without having first carefully read the 1000+ pages
- Information is not provided to show that new bylaws respect the urban plan
- New bylaws may actually go against sustainable development guidelines of the urban plan
- A new bylaws on conditional uses is introduced and it is not clear how this bylaw will be used in the future, especially for controversial installations such as cell phone towers
- Interestingly, on at the Aug 2 2010 Pierrefonds-Roxboro council meeting, the urbanist Pierre Rochon in response to a question, says that the new bylaws came into effect July 19 2010. If this is the case, then why are there not notices or communiqués of promulgation of these bylaws on either the borough or the City of Montreal Web sites for dates on or before July 19 2010?

2010-06-(21,22) – Results of the register

There was an important vote on June 21-22 2010 in the borough. Unfortunately the vast majority of residents were not aware of this vote. As a result, those who did not sign the register « voted » in favor of the new zoning bylaws which they were not familiar with. It appears council has also approved bylaws they had not fully read and may not have been familar with.

The APRPR thanks the more then 429** residents who signed the register against the new zoning bylaws. The APRPR continues to watch the harmonization of bylaws project very closely as it still maintains the manner in which this project is managed is very risky to proprietors and residents. The APRPR is also awaiting the final report of the Ombudsman of Montreal who is currently investigating on this matter.
** Oddly, one resident who signed late on june 22 thought that the number beside his name was closer to 500 and that with the remaining people left to sign that the total number of signatures would have easily been between 500-600.

How do the new bylaws differ from existing bylaws?
The borough and consultants have not provided key documents for residents to be able to easily compare the new proposed bylaws against the bylaws currently in effect.

2010-02-09 – Herculean (Olympian) task for residents
The borough publishes 1050 pages on its web site and invites the public to familiarize themselves with them.
The proposed documents are intended to replace Pierrefonds bylaws 1047, 1048, 1051, and 1109 and Roxboro bylaws 93-0555, 93-0556, 93-0557, 93-0558, 94-0572). A Herculean challenge during the 2010 Olympic games!

Here are more details on proposed changes to bylaws:

A proposed urban planning bylaw (54 pages) to replace both 1051 of Pierrefonds and 93-0558 of Roxboro (This bylaw was eventually withdrawn and would be adopted at a later time)

A proposed minor variances bylaw (12 pages) to replace Chapter XII of 1047 Pierrefonds and 93-0557 of Roxboro

A proposed subdivision bylaw (25 pages) to replace both 1048 of Pierrefonds and 93-0556 of Roxboro

A proposed « plans d`implémentations et intégrations architecturale (P.I.I.A.) » bylaw (80 pages + Annexe A et Annexe B) to replace both 1009 of Pierrefonds and 94-0572 of Roxboro

A new conditional uses bylaw for Pierrefonds-Roxboro. It is not clear how this bylaw will be used in the future, especially for controversial installations such as cell phone towers

A proposed zonging bylaw (358 pages and 12 Annexes of about 500 pages) to replace both 1047 of Pierrefonds and 93-0555 of Roxboro. This bylaw contains over 65 zone changes. Normally each zone change brings in $5000 to the borough. In this case the borough has decided to NOT collect the $5000 for each of the zone changes.

Un aménagement et des transports favorables aux jeunes

Bonjour,

Il me fait plaisir de vous informer qu’un nouveau guide réalisé par le Centre pour un transport durable, à l’intention des villes du Québec, Pour un aménagement et des transports favorables aux jeunes a été récemment mis en ligne sur le site www.jeunesenmouvement.ca.

Dans le cadre de cette publication, plusieurs groupes ont été consultés afin de développer des directives à l’intention des urbanistes et des spécialistes en transport, pour chacune des provinces du Canada. Les directives formulées visent à favoriser des arrangements en matière de transport et d’aménagement qui puissent satisfaire les besoins des jeunes – et du reste de la population.

Je vous invite donc à prendre connaissance de ce guide, réalisé au Québec par Paul Lewis et Alain Rajotte, tous deux chercheurs associés au Centre pour un transport durable.

Risks of harmonizing bylaws while province is updating land use planning and other laws

Is it risky for Pierrefonds-Roxboro to be updating major bylaws on urban planning and zoning while the province is simultaneously updating the laws that govern urban planning in the province.

Bill n°58 : An Act to amend the Act respecting land use planning and development and other legislative provisions concerning metropolitan communities

An Act to amend the Act respecting land use planning and development and other legislative provisions concerning metropolitan communities’

This newly revised land use planning speaks of « sustainable development.

The policy directions, objectives and criteria shall concern

(1) land transportation planning;

(2) the protection and enhancement of the natural and built environment, and of landscapes;

(3) the identification of any part of the territory of the metropolitan
community that must be the subject of integrated land use and transportation planning;

and

(7) the identification of any part of the territory of the metropolitan
community that is situated within the territory of two or more regional
county municipalities and is subject to significant constraints for reasons of public security, public health or general well-being; »

At this stage, it appears there has not been a document produced by Pierrefonds-Roxboro that clearly demonstrates that its new urban planning and zoning bylaws concur with this most recent provincial urban planning laws
